What this covers

This CURSED COVENANT (Legal Notice) sets out the warranty terms, responsibility, intellectual-property terms, and product-safety notices for everything sold by Wicked Wicks and More. It works alongside my other policies: the rules for shopping and conduct live in MALEVOLENT MANDATE (Terms of Service), how returns and defects are handled lives in REMORSEFUL REMEDIES (Refund Policy), and your data is covered in the PRIVATE PACT (Privacy Policy). Where those overlap, each policy governs its own subject.

Handmade, by hand

Everything here is made and packed by one person in small batches. That means small variations — slight differences in color, finish, alignment, or texture — are normal and are part of what you're buying, not flaws. Minor handmade variation consistent with the listing is expected; defects and material differences from the description remain covered. If something arrives genuinely defective or damaged, that's a different thing and it's covered in REMORSEFUL REMEDIES (Refund Policy).

Product safety & use

My products are decorative and household goods meant to be used sensibly and for their intended purpose. You're responsible for using them safely. In particular:

• Candles involve an open flame. Never leave a burning candle unattended, keep it away from anything flammable, children, and pets, and follow any burn instructions provided. Burning a candle is done at your own risk.
• Ceramics, coasters, and tile are durable but breakable, and can have firm edges. Follow the care notes on each product listing — they tell you what each piece can and can't handle.
• Small items like keychains and magnets are not toys and can pose a choking or ingestion hazard; keep them away from small children and pets.

To the fullest extent permitted by law, Wicked Wicks and More is not liable for injury, loss, or damage resulting from misuse, careless use, or use of a product other than as intended. Product-specific care instructions live on each product's own listing, so they stay accurate as products change.

Warranties

Products must match their description and meet the consumer warranties and standards that applicable law requires. Nothing in this policy excludes or shortens non-waivable express or implied warranties, including merchantability and fitness for a particular purpose, or your remedies for their breach. Handmade variation does not excuse a defect or a product that materially differs from its description. Contact me about any problem under REMORSEFUL REMEDIES (Refund Policy).

Limitation of liability

To the fullest extent permitted by law, Wicked Wicks and More is not liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, data, or goodwill — arising from your purchase or use of any product or this website. Any limitation applies only to claims for which the law permits a limitation; it does not reduce consumer warranty remedies, liability for negligence where it cannot lawfully be limited, or other non-waivable rights. Some jurisdictions don't allow these limits, so they apply to you only to the extent permitted by law. This doesn't limit any liability that legally can't be limited.

Intellectual property

The shop’s original designs, text, and brand assets belong to Wicked Wicks & More or their respective rights holders. Third-party names, trademarks, artwork, and customer-supplied photographs remain the property of their owners; depicting them does not transfer ownership or imply endorsement. Buying a physical product does not grant a license to reproduce or commercially exploit protected artwork. Wholesale or resale arrangements require separately agreed written terms.

Your submitted content

If you send a photo or other content for a custom order, you keep ownership of it — I don't claim it. By submitting it, you confirm you have the rights to use it and you grant me a limited license to use it solely to make your order. The full content rules, your representations, and what's prohibited are in MALEVOLENT MANDATE (Terms of Service); how I store and delete your photos is in the PRIVATE PACT (Privacy Policy).

Indemnification

To the extent permitted by law, you agree to cover and hold me harmless from claims, damages, and costs (including reasonable legal fees) that arise from your misuse of a product or from content you submitted for a custom order — for example, a claim that your submitted content infringed someone's rights or was used without consent.

Governing law

These terms and any dispute arising from them or from a purchase are governed by the laws of the District of Columbia, without regard to its conflict-of-laws rules. You agree that the courts located in the District of Columbia are the proper venue for any dispute, to the extent permitted by law.

Severability & changes

If any part of this CURSED COVENANT (Legal Notice) is found unenforceable, the rest stays in effect. I may update this notice from time to time for legal or operational reasons; the "Last Updated" date at the top reflects the latest version, and changes apply prospectively and do not remove rights attached to an earlier purchase.
